These Terms of Service ("Terms") govern your use of MÖDIX, a multimodal trip-planning service for British Columbia available on the web and as mobile apps (the "Service"), operated by the MÖDIX team ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
MÖDIX helps you plan trips across British Columbia using BC Transit schedules, driving, biking, walking, ferries, and (where available) ride-share options. Routes, schedules, and travel times are provided for planning purposes only and depend on third-party data that may change without notice. Always confirm departure times, fares, and service status with the operator before you travel.
2. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. Accounts are for individual use; do not share your account or let others use it. You must be at least 13 years old (16 in the EEA and UK) to use the Service.
3. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Scrape, crawl, or bulk-download data from the Service, or make automated requests that place unreasonable load on our systems or those of our providers (Google Maps, BC Transit, etc.).
- Reverse engineer, decompile, or attempt to extract source code from our apps.
- Block, hide, or interfere with advertising for free-tier users, or use tools designed to circumvent ad delivery in the mobile apps.
- Attempt to gain unauthorized access to other users' accounts or our infrastructure.
- Upload malicious content or use the Service to distribute malware or spam.
4. Advertising
The free tier of MÖDIX is supported by advertising. Ads on the web are served by Google AdSense; ads in the mobile apps are served by AppLovin MAX. See our Privacy Policy for details about how third-party ad partners use cookies and mobile advertising identifiers, and how to opt out of personalized advertising. Pro subscribers do not see ads.
5. Pro subscriptions and payments
MÖDIX Pro is an optional paid subscription that unlocks additional features and removes ads. On the web, subscriptions are billed by Stripe on a recurring basis until you cancel. On iOS and Android, subscriptions may be billed through the Apple App Store or Google Play; those purchases are governed by the store's terms and their refund policies apply. You can cancel at any time from your account page (web) or from your device's subscription settings (mobile). Access to Pro features continues until the end of the paid period; we do not provide pro-rated refunds except where required by law.
6. Third-party services and content
The Service integrates data and functionality from third parties, including Google Maps, BC Transit, ferry operators, ride-share providers, Stripe, AppLovin, and Google AdSense. Your use of features that rely on those providers is also subject to their respective terms and privacy policies. We are not responsible for the accuracy, availability, or actions of third-party services.
7. Intellectual property
The MÖDIX name, logo, software, and content (excluding third-party data) are owned by us and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. All rights not expressly granted are reserved.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that routes, schedules, fares, ferry sailings, or ride-share prices are accurate, complete, or current, or that the Service will be uninterrupted or error-free. You are responsible for your own travel decisions.
9. Limitation of liability
To the maximum extent permitted by law, MÖDIX and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for missed connections, delays, cancellations, lost profits, or lost data arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of CAD $50 or the amounts you paid us in the 12 months preceding the claim.
10. Termination
You may stop using the Service and delete your account at any time from the account page. We may suspend or terminate your access if you violate these Terms, misuse the Service, or expose us or our users to risk. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitations of liability, and governing law) will continue to apply.
11. Changes to the Service and Terms
We may change or discontinue features at any time. We may also update these Terms; material changes will be announced in the app or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising from or relating to the Service, subject to any mandatory consumer-protection rights in your place of residence.
